Terms & Conditions
These Terms & Conditions govern all rentals, deliveries, pickups, services, and use of equipment provided by Beach Baby Equipment Rentals. By placing an order, accepting delivery, or using any rental equipment, the customer agrees to all terms below.
1. Rental Agreement
All equipment remains the sole property of Beach Baby Equipment Rentals at all times. Customers receive a temporary, non-transferable right to use the rented items only during the agreed rental period.
2. Assumption of Risk
Customers acknowledge that the use of baby and beach equipment involves inherent risks, including but not limited to falls, injuries, drowning hazards, choking hazards, weather-related risks, equipment misuse, and transportation risks. Customers voluntarily assume all risks associated with the use of rented equipment.
3. Release of Liability
Beach Baby Equipment Rentals, its owners, employees, contractors, affiliates, family members, agents, and representatives shall not be liable for any injury, illness, death, loss, property damage, emotional distress, or expense arising from the use, misuse, installation, transport, setup, storage, or handling of rental equipment. Customers agree to release, indemnify, and hold harmless Beach Baby Equipment Rentals from any and all claims, lawsuits, demands, damages, attorney fees, settlements, or liabilities of any kind.
4. Equipment Inspection & Safe Use
Customers must inspect all equipment immediately upon delivery and notify Beach Baby Equipment Rentals prior to use if any issue is suspected. Equipment must only be used according to manufacturer specifications and intended use. Customers agree not to alter, misuse, overload, relocate improperly, or repair any rented item.
5. Supervision Requirement
Children using rental equipment must be supervised by a competent adult at all times. Beach Baby Equipment Rentals is not responsible for injuries or incidents resulting from inadequate supervision or misuse.
6. Cleaning & Sanitization
All equipment is cleaned, sanitized, and visually inspected between rentals. Customers acknowledge that rental items are previously used equipment and may contain ordinary cosmetic wear that does not affect functionality or safety.
7. Damage, Missing Items & Replacement Fees
Customers are fully financially responsible for any damaged, excessively dirty, stained, lost, stolen, broken, or missing equipment during the rental period. Damage and replacement fees may range from $50 up to $5,000 per item depending on the original retail value, repair cost, replacement cost, specialty sourcing requirements, labor, shipping, loss of use, and associated business interruption. Beach Baby Equipment Rentals reserves the sole right to determine repairability and replacement value. Additional charges may include deep cleaning fees, disposal fees, collection costs, attorney fees, and administrative costs.
8. Weather & Outdoor Use
Beach Baby Equipment Rentals is not responsible for injuries, damage, delays, or losses caused by weather conditions including but not limited to wind, storms, flooding, lightning, extreme heat, saltwater exposure, sand exposure, shifting dunes, or acts of nature. Customers are solely responsible for securing all outdoor equipment.
9. Delivery & Pickup
Delivery and pickup windows are estimates only and may vary due to traffic, weather, emergencies, road conditions, property access limitations, HOA restrictions, elevator restrictions, staffing, or unforeseen circumstances. Customers are responsible for providing accurate access information and ensuring a safe delivery environment.
9a. Pick ups occur as early as 9am and as late as 11am.
Drop offs occur between the hours of 2pm - 5pm
10. Cancellation & Refund Policy
Customers may cancel 21 days or more prior to the reservation start date for a full refund. Customers canceling within 14 days of the reservation start date may receive up to a 50% refund excluding delivery and setup fees. Customers canceling within 7 days of the reservation start date may receive up to a 25% refund excluding delivery and setup fees. Reservations canceled 6 days or less before the reservation start date are non-refundable. Last-minute reservations made within 24 hours of the reservation start date may not be canceled for a refund. A 75% store credit may be issued for future use within 2 years at the sole discretion of Beach Baby Equipment Rentals regardless of when or how the reservation was made.
11. No Guarantees & Substitute Equipment
Beach Baby Equipment Rentals reserves the right to substitute comparable equipment if necessary due to damage, safety concerns, recalls, inventory conflicts, transportation issues, or operational limitations.
12. Refusal or Termination of Service
Beach Baby Equipment Rentals reserves the right to refuse, cancel, terminate, or remove rental equipment at any time for unsafe conditions, misuse, threatening conduct, harassment, nonpayment, fraud concerns, violation of these Terms & Conditions, or any circumstance deemed inappropriate at the sole discretion of the company.
13. Indemnification
Customers agree to fully defend, indemnify, and hold harmless Beach Baby Equipment Rentals, its owners, employees, contractors, affiliates, agents, successors, heirs, and family members from any claim, demand, lawsuit, investigation, or liability brought by any third party arising out of the rental or use of equipment.
14. Limitation of Liability
To the fullest extent permitted by law, Beach Baby Equipment Rentals’ total maximum liability under any circumstance shall never exceed the total amount paid by the customer for the reservation.
15. Governing Law & Venue
These Terms & Conditions shall be governed exclusively under the laws of the State of New Jersey. Any dispute, claim, or legal proceeding shall be brought exclusively in the courts located within the State of New Jersey.
16. Binding Agreement
By submitting payment, electronically signing, accepting delivery, or using any rental equipment, the customer confirms they have read, understood, and agreed to these Terms & Conditions in full.
17. No Smoking & Pet Policy
Smoking, vaping, marijuana use, candle use, open flames, or pet use on or around rental equipment is strictly prohibited. Any evidence of smoke odor, burn damage, ash residue, pet hair, pet odor, pet stains, scratches, chewing, or other pet-related or smoke-related damage will result in immediate full replacement charges at the sole discretion of Beach Baby Equipment Rentals. Replacement fees may include the full retail value of the item, shipping, labor, sanitization, disposal, administrative fees, and loss-of-use costs.
18. Reservation Extensions
Beach Baby Equipment Rentals is happy to accommodate reservation extensions whenever inventory availability permits. Reservation extensions are not guaranteed and are subject to scheduling, inventory availability, staffing, and operational limitations. Additional rental fees, delivery fees, pickup adjustments, and applicable taxes may apply.
19. Last-Minute Reservations
Beach Baby Equipment Rentals is happy to accept last-minute reservations subject to inventory availability, staffing availability, and available delivery and pickup scheduling windows. Last-minute reservations may incur a nonrefundable $30 last-minute reservation fee regardless of whether the reservation is completed, modified, shortened, or canceled. Last-minute reservations are non-refundable; however, customers may receive up to a 75% store credit valid for up to two (2) years for future use with Beach Baby Equipment Rentals at the sole discretion of the company.
20. Lost & Stolen Equipment
Customers are fully responsible for any lost or stolen equipment during the rental period. A police report must be filed immediately for all lost or stolen items and a copy must be provided to Beach Baby Equipment Rentals upon request. Customers remain fully financially responsible for the replacement cost of all lost or stolen equipment regardless of whether a police report is filed. If lost or stolen equipment is later recovered and returned in acceptable condition after replacement charges have been paid, applicable replacement charges may be refunded accordingly at the sole discretion of Beach Baby Equipment Rentals. A nonrefundable $50 lost or stolen processing fee will apply to each incident in addition to replacement charges. A refundable fee of $25 is applied to each reservation. This fee is refunded at the conclusion of returned equipment inspection. If equipment is needing replacement, the $25 fee becomes non-refundable and will be applied to replacement costs.
